General Terms

1.1. AVCARS.eu (hereinafter referred to as the "Site") is a platform that provides information on the opportunity to purchase used vehicles through auctions and facilitates the technical possibility of participating in such auctions.

1.2. The Site is not the owner of the vehicles. All information about the vehicles is published based on data provided by their owners.

1.3. Under these Terms and Conditions (hereinafter referred to as the "Terms"), the term "services" refers to all actions available on the Site, including but not limited to: viewing information, participating in auctions (after registration and signing a contract), and other functionalities.

1.4. The services are provided by AVCARS/A.Viartsinski individuali imone, company registration number 304950946, VAT code LT100012017619, registered and operating under the laws of the Republic of Lithuania (hereinafter referred to as the "Service Provider").

2.1. These Terms and Conditions and the Privacy Policy govern the terms of use of the Site for all Visitors.

2.2. By using the Site, the Visitor fully agrees to these Terms and Conditions and the Privacy Policy.

2.3. If the Visitor disagrees with the terms, they must immediately cease using the Site and its services.

3.1. All elements of the Site (logos, texts, graphics, databases, design, software, etc.) are the intellectual property of the Site owner or the Service Provider.

3.2. Copying, modifying, distributing, or using any materials from the Site without the written permission of the copyright holder is prohibited.

4.1. Full access to the Site's functionality requires registration.

4.2. Registration is free of charge.

4.3. The Visitor must provide accurate personal or company data and create a secure password.

4.4. All provided information must be accurate, up-to-date and complete.

4.5. Data processing is carried out in accordance with the Privacy Policy.

4.6. After registration, the Visitor receives a confirmation by email.

4.7. Registered Visitors can view detailed vehicle information. Participation in auctions is only possible after signing the Agreement.

4.8. Registration of individuals and legal entities:

• Both individuals and legal entities are eligible for registration.
• All activities on the Site are governed by the laws of the Republic of Lithuania.

5.1. The contract between AVCARS and the buyer, incorporating these General Terms, shall be deemed concluded when the buyer registers in accordance with §4 of the Terms of Use and receives email confirmation of such registration.

5.2. The sales contract between AVCARS and the buyer, incorporating these Terms of Use, shall be deemed concluded when the buyer completes the purchase of a vehicle in accordance with the Terms of Use.

5.3. The AVCARS price lists valid at the time of transaction shall apply to all contracts.

5.4. To participate in auctions, participants must:

• provide a copy of identification document,
• sign a Contract with the Service Provider,
• fulfill other requirements stipulated by the Contract and Terms.

5.5. The Contract defines the auction participation procedure, as well as the rights, obligations and liabilities of the parties.

5.6. In case of discrepancies between the Terms and the Contract, the provisions of the Contract shall prevail.

5.7. The Contract is concluded electronically on the Site.

5.8. A copy of the document should be sent by email to: avcarsinfo@gmail.com.

5.9. After fulfilling all requirements, the Visitor gains the right to participate in auctions.

6.1. The Visitor agrees:

• Not to use the Site in ways that compromise its functionality, security or others' rights
• Not to copy or use Site elements without authorization
• Not to interfere with software operation or attempt hacking, decompilation, modification or circumvention of security measures
• To comply with applicable laws, these Terms and the Privacy Policy

6.2. The Service Provider reserves the right to:

• Deny registration or contract conclusion without explanation
• Block Visitors for rule violations
• Delete accounts inactive for 3 months without signed contracts
• Modify services, content and Site functionality
• Terminate Site operations at any time without prior notice

7.1. The Service Provider is not liable for temporary disruptions to the Site’s operation or for any potential losses, unless otherwise stipulated by the laws of the Republic of Lithuania.

7.2. The Visitor is responsible for any violations of these Terms, the Privacy Policy, or applicable laws and is obligated to compensate for any damages caused.

8.1. All provisions of these Terms shall be governed by the laws of the Republic of Lithuania.

8.2. Any disputes between the parties shall first be resolved through negotiations. If no agreement is reached within 15 (fifteen) calendar days, the dispute shall be submitted to the courts in accordance with the laws of the Republic of Lithuania.

9.1. The Service Provider reserves the right to unilaterally modify these Terms at any time.

9.2. Changes shall take effect upon their publication on the Site.

9.3. Continued use of the Site after the publication of changes constitutes the Visitor's acceptance of the updated terms.

9.4. Visitors who do not agree with the changes must cease using the Site.

10.1. The invalidity of any provision of these Terms shall not affect the validity of the remaining provisions.

10.2. The Visitor may not transfer their rights and obligations under these Terms to third parties without the Service Provider's written consent.
